Extension of Time to Comment on the Draft Regulations Regarding Extended Producer Responsibility

Summary of Intent
In Weekly Advocacy Alert 25/2020 CAIA alerted members to the Department of Forestry, Fisheries and Environment’s (DFFE) Consultation on the Proposed Extended Producer Responsibility Scheme. The DFFE engaged various stakeholders on the EPR Scheme and it was evident from those engagements that the extension of the comment period should be considered. CAIA and other stakeholders requested an extension of time to submit comments, and the DFFE granted an extension. This includes Regulations relating to the Electrical and Electronic Equipment Sector; Paper, Packaging and Single Use Products; as well as the Lighting Sector. Court Judgement: NERSA’s Decision on Eskom’s Fourth Multi-Year Price Determination for the 2019/20, 2020/21 and 2021/22 Financial Years

Summary of Intent
The High Court of South Africa, Gauteng Division, Pretoria, delivered a judgement on the National Energy Regulator of South Africa’s (NERSA) Decision on Eskom’s Fourth Multi-Year Price Determination (MYPD4) for the 2019/20, 2020/21 and 2021/22 Financial Years. The court declared as illegal NERSA’s decision to deduct a R69-billion equity injection into Eskom from its allowable revenue for the abovementioned period and has instructed that the full amount be added back to the utility’s allowable revenue over the coming three years. It is in accordance with the guidelines provided by the United Nations Framework Convention on Climate Change and follows the 2006 Intergovernmental Panel on Climate Change (IPCC) Guidelines and IPCC Good Practice Guidance.
