These regulations have been promulgated and have been in effect since 24 July 2015. Summary of Intent
Members were alerted to the availability of the draft National Pricing Strategy for Waste Management Charges for comment in Advocacy Alert 01/2015, on which CAIA engaged and provided comment. The final strategy is pending publication.The requirement for industry to submit waste management plans to the Minister for approval is one of the objectives of the strategy. Regulations for admission of guilt fines: National Environmental Management: Waste Act
Summary of Intent
The regulations took effect on 24 July 2015 and relate to offenses in terms of general waste only (wasted identified by Schedule 3 Category B of the National Environmental Management: Waste Act). Hazardous waste and priority waste is excluded from these regulations. Activities, for which offences with respect to waste are listed in the table contained in the regulations, include the following: storing, generating, discarding, providing information, directing other persons and transporting waste.

Should members be tracking the Government Gazette notices, the Department has confirmed that Notice 636 of 2015 can be ignored and has no effect. Notice 637 - the subject of the information below – is the complete Notice. Section 24G of the National Environmental Management Act provides for situations where relevant activities have commenced without the necessary environmental authorisation(s) and/or waste management license(s) having been obtained.
