Department of Agriculture, Land Reform and Rural Development

Application for derogation

Summary of Intent
The Fertilizer Association of Southern Africa (FERTASA) has informed the public of their intention to submit an application for derogation for the continued use of boric acid products, as applied to all registered fertiliser products in South Africa. The functions that boron performs cannot be substituted by any other chemical substance. However, according to the Globally Harmonized System of Classification and Labelling of Chemicals, boron has been identified as a substance of concern in the reproductive toxicity category 1B. A risk assessment was conducted that concluded there were insignificant health risks associated with boron-containing fertiliser products and as a result, no additional precautionary statements are required on the labelling. A 30 day period has been implemented for comments to be submitted by 25 April 2025.

Summary of Intent
In the run-up to the upcoming Basel, Rotterdam and Stockholm Conventions Conference of Parties meetings, a webinar will be held on 9 April 2025 from 11h00 to 12h30. The event entitled “The hidden plastic waste exports, the case for Basel Convention controls on refuse derived fuels (RDF) and textile waste. RDF consists of 30-60% mixed plastic waste and is destined to be burned in cement kilns, thermal power plants and incinerators, yet few parties accurately classify it as plastic waste using Basel waste codes and its export goes largely unrecorded. Similarly, around 60% of all textiles are made of synthetic polymers but in their waste phase are rarely classified as plastic waste with appropriate Basel codes. This event seeks to highlight these hidden plastic waste exports and how they can be brought into compliance with the Basel Convention.

Determination

Summary of Intent
A determination has been issued in terms of 34(1)(b) of the Act for the purpose of ensuring security of energy supply in the national interest. The determination recognises that new electricity transmission infrastructure is required to ensure the optimal supply of electricity, to be located across the Northern Cape, North-West and Gauteng. The infrastructure is to be procured by the National Transmission Company of South Africa SOC Limited from independent transmission providers.
