The Department of Environment, Forestry and Fisheries (DEFF) has published a Notice withdrawing the Section 28 Notice calling for the Paper and Packaging Industry, Electrical and Electronic Industry and Lighting Industry Waste Management Plans. This follows a number of plans that were received by DEFF which do not comply with the criteria expressly stipulated in the Section 28 Notice, and as a result could not be approved. The new approach will be centred on the Extended Producer Responsibility principle and would take into consideration the comments received from the relevant industries that generate waste.Your membership level does not allow you access to this content. Procedures for the Assessment and Minimum Criteria for Reporting Identified Environmental Themes when Applying for Environmental Authorisation

The Department of Environment, Forestry and Fisheries has published a Notice of procedures to be followed for the assessment and minimum criteria for reporting identified environmental themes when applying for environmental authorisation. This protocol provides the criteria for the assessment and reporting on impacts on terrestrial animal species for activities requiring environmental authorisation.

Each protocol applies exclusively to the environmental theme identified within its scope. Multiple themes may apply, and assessments for these themes must be undertaken in accordance with the relevant protocol, or, where no specific protocol has been prescribed, in accordance with the requirements of the Environmental Impact Assessment Regulations, as amended.Your membership level does not allow you access to this content. Draft Upstream Petroleum Resources Development Bill for Public Comment

Summary of Intent
The Department of Mineral Resources and Energy has published the draft Upstream Petroleum Resources Development Bill for public comment. The Bill aims to:

  • make provision for equitable access to and sustainable development of the nation’s petroleum resources;
  • provide for orderly development of petroleum resources;
  • create an enabling environment for the acceleration of exploration and production of the nation’s petroleum resources,
  • provide for active State participation in the development of the nation’s petroleum resources;
  • provide for black person’s participation in the upstream petroleum sector;
  • provide for the establishment of the Petroleum Agency of South Africa as the national regulatory authority for the upstream petroleum sector;
  • provide for the objectives and functions of the Agency;
  • provide for the constitution of the Board of the Agency, the appointment of the Chief Executive Officer of the Agency, the staff and the finances of the Agency;
  • provide for the designation of PetroSA as a National Oil Company; and
  • provide for matters connected therewith.

The National Energy Regulator of South Africa (NERSA) has received a transmission tariff application from the Republic of Mozambique Pipeline Investments Company (ROMPCO). The application is for the approval of the piped-gas transmission tariff for volumes arising from investment in Loop line 2 for the period 1 January 2020 to 31 December 2022. Approval of the Draft Biofuels Regulatory Framework

The ordinary Cabinet meeting of 13 December 2019 approved the Department of Mineral Resources and Energy Draft Biofuels Regulatory Framework subject to incorporation of amendments required. In addition, the Mandatory Blending Regulations will also be amended to be in line with the Biofuels Regulatory Framework as approved by the Cabinet.
